Terms of Service

These Terms of Service ("Terms") govern your access to and use of SideQuest's website and mobile application (together, the "Service"), operated by SideQuest ("we," "us," or "our"), based in Poland and offered to users worldwide. By joining the waitlist, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SideQuest lets you and a closed circle of friends assign each other real-world "dares" with a deadline, submit proof of completion, and receive a majority verdict from your circle that awards or withholds in-app experience points ("XP"). A solo mode is also available for users without a circle. The Service is currently in a pre-launch, early-access ("waitlist") stage; features described on our website may change before general availability.

2. Eligibility

You must be at least 16 years old to use the Service. If the age of digital consent in your country is higher than 16, you must meet that higher age requirement, or use the Service only with the consent of a parent or legal guardian where your jurisdiction permits.

3. Waitlist and Early Access

Joining the waitlist does not guarantee you access to the Service, a specific invitation date, or that any particular feature will be available at launch. We may modify, delay, or discontinue the waitlist or early-access program at any time without liability to you.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or to assign or complete a dare that is illegal, or that a reasonable person would consider likely to cause serious harm to any person, animal, or property;
• Harass, threaten, or abuse other users;
• Attempt to gain unauthorized access to the Service or interfere with its operation;
• Impersonate another person or misrepresent your affiliation with anyone.

We may suspend or terminate access for any user who violates this section.

5. Assumption of Risk — Dares Are Your Responsibility

Dares are created by your friends or by you, not by SideQuest, and SideQuest does not review, approve, or endorse any dare before it is issued. You are solely responsible for deciding whether to accept, attempt, or complete any dare, and for exercising good judgment about your own safety and the law. To the fullest extent permitted by law, SideQuest disclaims all liability for any injury, loss, damage, or legal consequence arising from your decision to attempt or complete a dare, whether or not it was suggested, verified, or judged through the Service. Never attempt a dare that could put you or anyone else at serious risk.

6. Your Content

Proof you submit (photos, videos, screenshots, and similar content) remains yours. By submitting it, you grant SideQuest a limited license to store and display that content to the members of your circle (or, in solo mode, to you) for the purpose of operating the Service. You represent that you have the right to share any content you submit and that it does not infringe on anyone else's rights.

7. Intellectual Property

The SideQuest name, logo, and the design of the Service are owned by SideQuest or our licensors. These Terms do not grant you any right to use our trademarks, branding, or design without our prior written permission — our Press Kit describes the limited uses we do permit.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time.

9. Limitation of Liability

To the fullest extent permitted by law, SideQuest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Because the Service is currently offered free of charge during the waitlist/early-access stage, our total aggregate liability to you for any claim arising out of these Terms is limited to the greater of the amount you paid us in the twelve months preceding the claim (currently zero) or fifty euros (€50).

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service, or ask us to delete your waitlist entry, at any time.

11. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles, regardless of the country from which you access the Service. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of Poland, except where mandatory consumer-protection law in your country of residence requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective" date above and, where appropriate, notify waitlist subscribers by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
